I know the case your hinting at and unless we know more about how it was dealt with you can only assume a warning was given. My understanding of data protection is that they are pretty reasonable. However if you take the route of telling them to stick their laws where the sun dont shine or just ignore their guidance you pay the consequences.

yes but didnt the person in question say they would do it again, so surely that other person has more or less said the exact same thing

I dont know how each individual case has been dealt with but I am assuming that one did apologise and has not repeated the offence  and the other said stick it I am above the law or  something similarly stupid.
